An area man’s appeal to homicide charges has moved forward to State Superior Court.
The state has received the Indiana County Court docket of the prosecution of 64-yr-old David Yingling, of Arcadia. Yingling plead guilty last year to third degree murder in the shooting death of his roommate, 50-year-old Elwood Skillman, in a home along Arcadia Road in remote Montgomery Township.
Investigators found his decomposing body when police, acting on a tip from an informant, showed up several days later. Yingling said he shot Skillman because he’d been bullying Yingling’s mentally challenged younger brother.
In March, Yingling filed for post conviction sentence relief trying to reduce his 17-and-a-half to 35-year state prison sentence, and his court-appointed attorney then filed an amended motion in July.
Indiana County Judge Thomas Bianco denied the motion in September, prompting the appeal the Superior Court by a new attorney.
