A new Pennsylvania law has changed the grading of certain offenses for driving under the influence (DUI), by adding more stringent penalties.
Under the new law, an individual charged with DUI (general impairment) who refuses a breath or chemical test or who is charged with DUI with a BAC of .16 or higher, and already has two prior offenses will now face a felony of the third-degree, punishable by a maximum of seven years in prison. Three or more prior offenses constitutes a felony of the second-degree, punishable by a term of imprisonment of 10 years.
